Last Will and Testament

  


I, William Clancy of Johnstown, Fulton County and the State of New York, being of sound and disposing mind, memory and understanding, do this day make and publish my last will and testament in manner and form as follows:

Firstly, I direct my executors and executrixes, hereinafter named, to decently bury me in a decent and Christian like manner and out of my personal estate of property to take the necessary expenses, and also order and direct them to obtain and procure out of my personal funds and property a plain and decent tombstone and footstone and have the same paid up at my expense in a reasonable time after my decease.

Secondly, I give to Mary, my beloved wife, fifty dollars to be paid to her by my executors and executrixes hereinafter named, within forty days after my decease.

Thirdly, I give, devise and bequeath unto my son David all my real estate situate, lying and being within the county of Fulton to have and to hold to him and his heirs and assigns forever subject (unreadable) to the payment of thirty dollars within six months from the time I have directed my executors and executrixes to pay my wife the aforesaid fifty dollars to my said wife and every six months thereafter to pay the like sum of thirty dollars for and during as long as she remains my widow and, I hereby charge said monies to be a lien and charge on the premises (unreadable) to my said son and order him to pay said moneys.

Fourthly, I give, devise and bequeath unto my son John all my real estate situate, lying and being within the county of Schenectady to have and to hold to him and his heirs and assigns forever subject (unreadable) to the payment of twenty dollars within six months from the time I have directed my executors and executrixes to pay my wife the aforesaid fifty dollars to my said wife and every six months thereafter to pay the like sum of twenty dollars for and during as long as she remains my widow and, I hereby charge said monies to be a lien and charge on the premises (unreadable) to my said son and order him to pay said moneys.

Fiftly, I hereby declare, order and direct that the provisions herein made to and for my beloved wife is to be taken deemed and adjudged to be for my beloved wife and in lieu of all rights (unreadable) she may be entitled to by law.

Sixthly, I (unreadable) bequeath the rest and (unreadable) estate of mutual property to my children to wit, David, John, Sally, Elizabeth and Lydia to have to hold to them and their respective executors (unreadable) and assigns forever equally and (unreadable).

Seventhly, I hereby nominate (unreadable) my said children, David, John, Sally, Elizabeth and Lydia to be the executors and executrixes of this my last will and testament. In witness whereof, I have hereunto put my hand and affixed my seal this twenty eighth day of June, in the year of our Lord, one thousand eight hundred forty five.

Signed, sealed, published and declared by William Clancy to be his last will and testament in our presence and me in his presence and in the presence of each other and at his request, have subscribed our names as witnesses.
