This Indenture,
Made the fourth day of May in the year One Thousand Nine Hundred Four, Between Mary LUTZ of the city of Johnstown, County of Fulton, and State of New York, party of the second part;

Whereas, William LUTZ, of the City of Johnstown, County of Fulton and State of New York by Indenture of Mortgage, bearing date the eleventh day of December One Thousand Nine Hundred One recorded in the office of County Clerk of the County of Fulton in Liber 88 of Mortgages, page 267 on the eleventh day of December 1901, for the consideration therein mentioned, and to secure the payment of the money therein specified, did convey certain lands and tenements of which the lands hereinafter described are part , unto MARY LUTZ.

And Whereas, the said party of the first part, at the request of the said party of the second part, has agreed to give up and surrender the lands hereinafter described unto the said party of the second part, and to hold and retain the residue of the mortgaged lands as security for the money remaining due on the said mortgage.

Now this indenture witnesseth, that the said party of the first part, in pursuance of the said agreement and in consideration of Three Hundred Sixty and 80/100 Dollars ($360.80) to him duly paid at the time of the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, released, quit-claimed, and set over, and by these presents does grant, release, quit-claim and set over unto the said party of the second part, all that part of the said mortgaged lands.

All that tract or parcel of land situate in the City of Johnstown, County of Fulton, and State of New York, bounded and described as follows to wit: Bounded on the north by lot owned by Winfield Bragdon, formerly owned by James K. Young, on the east by lot owned by George Grandy, formerly owned by Emily J. Frank, on the south by Clinton Street, and on the west by Glebe Street, and being the same premises as were conveyed to party of the first part hereto by Michael L. Fancher and wife by deed dated September 26, 1900, and recorded in Fulton County Clerk's office October 15, 1900, in book 105 of Deeds, page 565.

Together with the hereditaments and appurtenances thereunto belonging: and all the right, title, and interest of the said party of the first part, of, in and to the same, to the intent that the lands hereby conveyed may be discharged from the said mortgage, and that the rest of the lands in the said mortgage specified may remain to the said party of the first part as heretofore. To have and to hold, the lands and premises hereby released and conveyed to the said party of the second part, her heirs and assigns, to their own proper use, benefit and behoof forever, free, clear, and discharged of and from all lien and claim under and by virtue of the Indenture of Mortgage aforesaid.

In Witness Whereof, the said party of the first part to these presents has hereunto set his hand and seal the day and year first above written.
