Warranty Deed
Elizabeth Getman and Menzo Martin

 

This deed was transcribed for the site by Allyn Hess Perry, co-cordinater Wayne County GenWeb, who was born in Ilion, but over the past several years  or so found out that many of her ancestors are from Oppenheim, St. Johnsville, Dolgeville and is trying to figure out where other connections are.  Her ancestors are: William S. Hess (1842-1921) married Sarah Lassell (1846-1896) -they are buried in the Rural Cemetery in Ingham Mills.   Martin Keck and Andrew Keck (wife Catherine Burns) from Oppenheim. Then there is Salem Clemons (1856-1928), another Gr Grandfather from Oppenheim. I'm curious about Hessville - there is only a small mention of it in a book about Fulton Co.  Someone must have heard stories about it..........If you are related to these families or have information, Allyn would love to hear from you!

Note:  {Throughout the body of this paper the name Putman is spelled as so. However, the signatures show the spelling to be Putnam. –ahp}

  


THIS INDENDURE Made this twenty third day of May in the year of our Lord one thousand eight hundred and ninety nine Between Elizabeth Getman of Johnstown, N.Y., Abbie Putman of Jordan, N.Y., Eugene Putman and Jennie Putman of the town of ____ in the County of Schoharie, N.Y. and Simeon Vrooman and Bertha Vrooman of Fonda, N.Y. parties of the first part, and Menzo Martin of the town of Johnstown in the County of Fulton, N.Y. party of the second part,

WITNESSETH, That the said partner of the first part, in consideration of the sum of Two Hundred Dollars to them duly paid, have sold, and

THESE PRESENT, do grant and convey to the said party of the second part his heirs and assigns, ALL that certain piece, parcel or lot of land situate lying and being in the town of Johnstown, County of Fulton N.Y. bounded and described as follows to wit:   Bounded on the northerly by the public highway known as and commonly called the Ephratah Plank road; Easterly by lands lately owned by Philip Martin now deceased, and by him devised to Alexander Martin (his son); Southerly by lands of said Menzo Martin and westerly by the public highway leading from the highway above mentioned to the highway known as the new turnpike and containing about five acres of land of which Cornelius Putman died seized and possessed, and which with other lands, was inherited from him by the said Elizabeth Getman – his daughter and the said Eugene Putman his son, and George Putman now deceased, also his son,  who was the husband of said Abbie Putman to whom he conveyed his interest in said lot and other lands, and also Delia Vrooman, also a daughter, now deceased, who was the wife of said Simeon Vrooman, and mother of said Bertha Vrooman, his only heirs at law, and next who survived him.

WITH THE APPURTENANCES, and all the Estate; Title and Interest therein of the said parties of the first part. And the said Elizabeth Getman, Abbie Putman, Eugene Putman, and Bertha Vrooman do hereby covenant and agree to and with the said party of the second part, his heirs and assigns, that the premises thus conveyed in the Quiet and Peaceable Possession of the said party of the second part, his heirs and assigns they will forever Warrant and Defend against any person whomsoever lawfully claiming the same, or any part thereof.

IN WHITNESS WHEREOF, the partners of the first part have hereunto set their hands and seals the day and year first above written..

On this 23rd day of May in the year one thousand eight hundred and ninety nine before me, the subscriber, personally came Elizabeth Getman to me known to be the person described in and who executed the within instrument, and she acknowledged that she executed the same.

Brawley whose name is subscribed to the certificate of the proof or acknowledgment of the annexed instrument, was at the time of taking such proof or acknowledgment a JUSTICE OF THE PEACE in and for said County, and duly authorized to take the same; and that I am well acquainted with his hand writing and verily believe the signature to said certificate to be genuine. And to the existing laws of the State of New York.

AKELEY, Clerk of said County, and of the Supreme and County Courts, held therein, the same being Courts of Record, Do hereby certify, that Clarke Shaule, Esp., whose name is subscribed to the Certificate of Proof of Acknowledgment of the annexed instrument, was, at the time of taking the same, a Justice of the Peace in and for the said County, dwelling in said County, sworn and duly authorized to take the same; that I am well acquainted with his hand-writing, and verily believe that the signature thereto purporting to be his is genuine, and that said instrument is executed and acknowledged according to the Laws of the State of New York.

In Testimony Whereof, I have hereunto set my hand and affixed the Seal of said Courts and County this 1st day of July 1899.
